Welcome to Memory Mount. These Terms of Service (“Terms”) govern your access to and use of the Memory Mount mobile application, website, and related services (collectively, the “Service”) provided by Memory Mount (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Memory Mount is a platform that enables hunters and outdoor enthusiasts to document, store, and share their hunting memories. The Service allows users to create digital records linked to physical trophy mounts via NFC technology, upload photos, and manage personal hunt logs and trophy information.
You must be at least 13 years of age to use the Service. By agreeing to these Terms, you represent and warrant that you meet this age requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
To access certain features of the Service, you must register for an account. You agree to:
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable notice where practicable.
The Service allows you to upload, store, and manage content such as photos, descriptions, and hunt-related data (“User Content”). You retain ownership of all User Content you submit. By uploading User Content, you grant Memory Mount a non-exclusive, worldwide, royalty-free license to store, display, process, and reformat your content solely to provide and improve the Service. This includes the right to convert, compress, resize, or otherwise reformat media files (such as photos and videos) for performance and storage optimization purposes. Such reformatting does not affect your ownership of the original content.
You represent and warrant that your User Content does not infringe any third-party rights and does not violate any applicable law. We reserve the right to remove any content that violates these Terms.
You agree not to use the Service to:
All rights, title, and interest in and to the Service (excluding User Content), including all associated software, design, text, graphics, logos, and other materials, are and will remain the exclusive property of Memory Mount and its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features without our prior written consent.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our practices.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Memory Mount is not responsible for ensuring compliance with any applicable hunting laws, licensing requirements, or regulations. Users are solely responsible for complying with all applicable laws in their jurisdiction.
TO THE FULLEST EXTENT PERMITTED BY LAW, MEMORY MOUNT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Memory Mount and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the applicable courts of competent jurisdiction.
We may update these Terms from time to time. We will notify you of material changes by updating the effective date at the top of this page and, where appropriate, by sending a notification through the Service or via email. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including if we reasonably believe you have violated these Terms. You may also delete your account at any time through the account settings. Upon termination, your right to use the Service ceases immediately.
